Advantages of the handwritten signature
The handwritten electronic signature, which is done on a signature pad or mobile device with pen input, is becoming more and more important. Only it alone represents a simple continuation of the traditional work process: the writing of a signature, in electronic form.
The signotec technologies for recording individual signature features has been studied by an independent expert in written literature. With regard to "the detailed graphic and forensic analysis in the context of a court-validated, scripture-comparative, authorship investigation", in a report the usability was confirmed and even found to be better than original signatures on paper!
The general security of the solution has already been tested by independent institutes such as the TÜV. Furthermore many well-known signotec customers successfully tested and certified the systems.
The handwritten electronic signature is also particularly easy to introduce, since it is based on a well-known process. The process of signing is familiar to many people. In this respect, it assumes a particularly strong trust relationship.
The classic signature has considerable advantages over card and PIN systems:
- Signing is a well-known, common process
- You can not lose it
- The signature can not be forgotten
- A transfer is excluded
- The signature will never be given unintentionally
- It is accepted for the certification of declarations of intent
The biometric, handwritten signature is not only a image attached to the document to be signed, but also links the signature and the biometrics to the documents in such a way that a manipulation is recognized. Very important: The signer can be authenticated based on his biometric parameters, which he gives when signing. Checking the documents for integrity is possible at any time using standard means (such as the Adobe Reader).
e-Signatures and eIDAS
Since 1st July 2016, the EU-wide eIDAS Regulation has regulated the legal and technological basis for electronic signatures in Europe. eIDAS stands for "electronic IDentication, Authentication and trust Services". The new ordinance replace the previously valid EU Directive 1999/93 / EC. The purpose of the legal amendment was the European standardization and acception of electronic signatures as well as the promotion and development of their digital applications.
Forms of electronic signature
The eIDAS regulation contains, as before the EU directive, a subdivision into 3 different quality levels of the electronic signature, which can be used for different applications:
- Simple electronic signature (SES)
The simple electronic signature is, as the name implies, a simple way that offers little or no evidence in court. For example, it may be a scanned signature placed as an image under documents. Taking legal risks into account, this form is usually only suitable for internal processes, such as: Expense reports, approval processes, etc.
- Advanced electronic signature (AES)
The advanced form of the electronic signature offers a much higher probative value than the simple one. In the event of a dispute, it enables accurate validation of the signature, consisting of document integrity and authentication of the signatory. This will determine if the document has changed and which person has signed it. This form of e-signature is particularly good for all form-free processes, such as correspondence, contracts and agreements with customers and partners. Thus, always when it comes to a declaration of intent to a certain process evidence and legally compliant to document.
- Qualified electronic signature (QES)
The qualified electronic signature describes the highest quality level of the e-signature and can be the only one to replace the written form if required by law (<5% of all business transactions in Germany). The big disadvantage of the QES is still the small area of application and the low popularity. A classic smart card system requires that each signatory has his own card and certificate to sign. In everyday life, this is extremely impractical, since hardly anyone has such a card or the required technologies. New, cloud-based technologies of the "remote signature" or "company seals" promise to facilitate the handling of qualified signatures - but here too, each person must be individually identified and verified, for example via video or post-ident. Again, this poses a major obstacle in many places in such a fast-paced age. From the consumer's point of view, it also has the big disadvantage of the reversal of the burden of proof: in the event of abuse, the consumer must prove it!
Advanced electronic signatures with signotec
With our electronic signature capture products via pen pads or mobile devices, signing a PDF, "advanced electronic signatures" are created in compliance with the ISO standard (PDF standard).
Basically, the following requirements are fulfilled:
- It is assigned exclusively to the signatory
- It enables the identification of the signer
- It is created with technologies, that the signatory can keep under its sole control
- It is linked to the data to which it relates in such a way that a subsequent change is detected
The task is the assignment of a handwritten, electronic signature to a document and of course to a person. The necessary technology consists of the following elements:
- An electronic signature pad by signotec for capturing the signature with high-quality biometric parameters (at least 1.024 pressure stages and 500 Hz sampling rate).
- A software that incorporates the visual and biometric features into the document and reliably protects the document against manipulation, such as signoSign/2 or signoSign/Universal or their associated SDKs.
- An interface that transfers the signed document to an existing document management system without media discontinuity.
- Software that verifies that the signature has been provided by the right person and that document integrity is guaranteed.
- By transferring the signed, electronic documents into the workflow of a document management system, costs are reduced, processing and processing times are accelerated and abuses avoided.
Legitmacy in a legal proceeding
The eIDAS Regulation again emphasizes the judicial usability of electronic signatures.
Art. 25 "Legal effects of electronic signatures" states:
"An electronic signature shall not be denied legal effect and admissibility as evidence in legal proceedings solely on the grounds that it is in an electronic form or that it does not meet the requirements for qualified electronic signatures."
This means that advanced electronic signatures can not be ignored as evidence. So you can in any case introduce the specific security features into a lawsuit.
Qualified electronic signatures with signotec
In addition to the advanced e-signature via pen pad or mobile device, we also offer options for creating qualified signatures.
- Smart Card
The software "signoSign/2" offers an interface to electronically sign documents with the use of card reader and smart card. In this case, no signature is recorded, but the document is signed solely with the certificate of a personal signature card, or both. Thus, a signature can be captured by QES and / or AES with pad.
- Remote signature
The web-based integration product "signoSign/Universal" has a prepared interface, which enables qualified remote signing of PDF-documents for example via mobile signature. Instead of a signature, the registered signatory is authenticated via his mobile phone and signs the document in this way. The respective service providers of the remote signature must be implemented individually. We are happy to assist you at any time.
Areas of application
Areas of application for electronic signatures are wherever documents have to be signed today and then processed electronically: financial institutions, insurance, logistics, healthcare, services, industry and many more. Experience in practice shows that the costs are reduced by up to 80 percent with the use of the signotec solution. Using the handwritten electronic signature, the process chain of the digital document can be realized from creation to archiving without media breakage. An ROI (return on investment) of less than 6 months is confirmed by our customers.
